1. SERVICE TERMS AND CONDITIONS
(a) FEES - The first month's fee is due within ten days of opening your account. Each month's fee is due by the start date of that account. Any account fifteen (15) days past due will be suspended. IWVISP reserves the right to cancel any delinquent accounts without notice.
(b) DIAL-UP ACCOUNTS - A Dial-up Account is limited to one user per account (Only one simultaneous login per account.) Accounts are dynamically addressed. Running of Internet Servers including but not limited to mail, news, web, muds, mushes, moos, etc are prohibited on Dial-up accounts.
(1) USAGE - Unmetered attended access is allowed. Making multiple simultaneous connections is prohibited. Giving, loaning or in any way permitting another person to use your account is prohibited. Giving out your password to another person or entity is prohibited. Any illegal or prohibited use of an account, connection, or server space may result in immediate disconnection of your service pending investigation. IWVISP will not be responsible for any monetary or other losses resulting from such disconnection.
(2) CAMPING - "Camping" on IWVISP is prohibited. Camping is defined as maintaining an open connection while not personally and actively using the account. Using automated bots, e-mail checkers, pingers, etc to maintain "Camped" connections is prohibited. Continuous connections exceeding eight hours will be accepted as proof of camping unless the subscriber provides reasonable explanation and repeat occurrences are rare or previously announced to IWVISP staff.
(c) DSL/WIRELESS SERVICE – Accounts more than 30 days past due and that are in a suspended status for non-payment may incur a $10 service charge for reinstatement of services. DSL/Wireless service utilizes static IP addresses. Customers are encouraged to maintain a firewall to thwart unauthorized access. IWVISP is not responsible for hacking attempts.
(d) SECURITY - Probing system resources and configurations for possible security holes, bugs, or other malfunctions are prohibited.
(e) DATA STORAGE - Storage of unlicensed software is prohibited. Illegal or unauthorized access and/or use of data on the network is prohibited.
(f) INFORMATION AND CONTENT - IWVISP exercises no control over the Content of information passing through IWVISP. IWVISP will not warrant the accuracy or confidentiality of any information contained on IWVISP. The users of IWVISP are solely responsible for the information contained in IWVISP. Your use of IWVISP is conditional upon your agreement to indemnify IWVISP for any action arising from your use or transmittal of information or material deemed obscene, threatening, or otherwise illegal, including improper use of copyrighted materials.
(g) DEDICATED ACCOUNTS - Dedicated accounts are for one organization only. Running Internet Servers is permitted on Dedicated accounts.
(h) RESALE IWVISP - accounts and services are not open to resale. Any IWVISP services including but not limited to news, e-mail, irc, web pages, ftp site, etc are for the sole use of the subscriber and can not be loaned, borrowed, or sold to any other person or entity.
(i) LIABILITY IWVISP - is not responsible for damage due to the use of any information or software obtained by or through the use of IWVISP services. Any illegal use of any software may result in legal action, pending investigation. IWVISP will not be responsible for any monetary or other losses resulting from the use of any information or software obtained by or through the use of IWVISP services.
(j) MINOR ACCOUNTS - Minors (under age 18) are not permitted to open IWVISP accounts.
(k) HARRASSMENT - Harassing of other IWVISP subscribers through network resources is prohibited. Sending of unwanted e-mail, files, news, or other contacts may constitute harassment. A subscriber should express the unwanted nature of any communications in clear and direct language. If a subscriber continues to receive unwanted communications, they may contact IWVISP management for assistance. Harassing communications originating outside IWVISP should be forwarded to federal authorities. IWVISP has no control over activities outside our immediate system.
2. DISCLAIMER
IN NO EVENT SHALL IWVISP BE LIABLE FOR ANY DIRECT, CONSEQUENTIAL, INDIRECT, INCIDENTAL, OR SPECIAL DAMAGES WHATSOEVER, INCLUDING WITHOUT LIMITATION, DAMAGES FOR LOSS OF BUSINESS PROFITS, BUSINESS INTERRUPTION, LOSS OF AND/OR DAMAGE TO DATA, AND EQUIPMENT.
IWVISP RESERVES THE RIGHT TO REFUSE SERVICE TO ANYONE WITHOUT CAUSE, AND WITHOUT RECOURSE.
IWVISP reserves the right to modify this agreement. These terms and conditions reflect the entire agreement between IWVISP and the users of IWVISP services and will supersede all prior oral and written agreements and understandings. By continuing to use IWVISP services, the user agrees to abide by the terms and conditions set forth in the latest version of the Terms and Conditions.
